Trans filmmaker Sam Feder's recent film "Heightened Scrutiny" offers a moving two-part viewpoint – simultaneously an intimate portrait of a key trans advocate and a pointed analysis of journalistic reporting about trans existence.

Legal Battle at the Highest Court

This feature documents ACLU lawyer Chase Strangio as he gears up for court proceedings in the important highest court case the Skirmetti case. These proceedings occurred in December 2024, with the judiciary ultimately ruling in support of Tennessee's case, effectively permitting limitations on healthcare for transgender youth to stay in place across multiple US territories.

We made Heightened Scrutiny in only 16 months, explained Feder during a discussion. Meanwhile, my previous film Disclosure took me half a decade, so this was quite rushed. Our intention was to stimulate conversation so people would know more about the case.

Personal Narrative Amid Political Struggle

Although Feder presents a comprehensive critique of how major publications have disseminated anti-trans rhetoric, the film's greatest contribution may be its compelling depiction of Strangio. Normally a cautious attorney in public settings, Strangio shows his authenticity throughout the documentary.

This represented a significant challenge, to open up parts of my life to a filmmaker that I had strived to keep personal, shared Strangio. Sam explained he wanted younger people to know that we struggled, to see what was done in support of these fights for our material survival.

Diverse Voices in the Movement

To strengthen Strangio's account, Feder includes multiple trans voices, such as well-known individuals from activism and the arts. This production also features perspectives from cisgender allies who analyze how respected media outlets have contributed to harmful coverage of trans individuals.

The viewpoint of transgender minors central to the legal case is shown through a impressive 12-year-old student named Mila. Viewers initially witness her speaking out for her community at a school board meeting, with subsequent moments showing her protesting for trans rights outside the highest court.

Intimate Moments Beyond the Courtroom

Heightened Scrutiny also includes touching moments where Feder moves beyond the constant political struggle, such as scenes of Strangio vacationing in Italy and getting a body art featuring lines from activist Pauli Murray's poem "Prediction."

This ink scene is one of my favorites in the movie, stated Strangio. Being tattooed is almost like a reflective process for me, to be fully present in my body and to consider it as a vehicle for things that are meaningful to me.

Physical Identity and Representation

Feder's focus to thoughtfully documenting Strangio adding to his body art emphasizes that this film is primarily about trans physical selves – not only those of young people who experience restriction of their right to live truly in their own bodies, but also the physical forms of the various participants who appear in the documentary.

I produce films with a message, and part of that is choosing people who are exceptional and eloquent enough to hold the camera, stated Feder. When people ask me what they should wear for an filming, my reply is whatever makes you feel confident. This is essential to me – as transgender individuals, we struggle so much with our appearance.

Impact and Optimism

A key factor that makes Feder's documentaries excel is his obvious ability for making his trans participants feel at ease, recognized and valued. This methodology fosters real rapport between Feder and Strangio, allowing the director to accomplish his goal of portraying Strangio as a whole human being and providing a testament for posterity of how resiliently he and others have fought for trans rights.

I hope not people to end up in a place of incessant hopelessness because of what the law is failing to provide us, shared Strangio. I want to be in a practice of using the law to minimize harm, but not to turn it into some kind of pathway for our liberation potential. Official institutions is not going to be the mirror through which we see ourselves. Trans people are that reflection, and it's very vital that we keep having that conversation alongside dialogues about fighting back these regulations and procedures.
