Federal Court Orders Freedom of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The case originates in a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an error. After his repatriation to the United States to answer alien smuggling allegations, he was held in federal custody.

In her decision, the court noted that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."

Background of the Case

The legal challenge center on disputed claims. Whereas the former administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he categorically disputes this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate trial in Tennessee.

Conditions of Freedom

The court, who was overseeing his challenge to removal in a Maryland district court, ruled that he must now comply with the conditions of his release from jail in Tennessee. This order effectively transfers his supervision to the jurisdiction handling his criminal case.
